How much are the Mediation Fees?

  • The fee will be set in advance by the Mediator on a sliding scale relative to the amount in controversy.
  • The standard proposed fees are between $2,500 and $7,500 per party, depending on the size of the claims. Optional AI settlement assist software can also be utilized at an additional charge if the parties agree.

(Additional fees are also charged if the mediation goes beyond one day.)

Does the mediation include a review of legal authorities? 

Yes, the Standard Mediation Terms (see this tab) contemplate two briefs per side, with exhibits.

How are the mediations conducted?

All mediations are conducted via Zoom.

Can the Mediation utilize AI software in connection with the Mediator’s settlement assessment?

Using a well-established AI product, but adapting it to account for our long-experience in the field, we are able, if the parties so choose, to attempt to have the software provide its own suggested settlement range, taking into account our unique experience in court as to what a Judge would consider the most pertinent facts in the case, and the established law, the latter of which is already programmed into the software.
